Appendix EU – Family Permit

After Brexit in 2019 Appendix EU Family permit was incorporated. The appendix is a consolidated version of Immigration rules. The appendix EU applies to EU nationals and non- EEA nationals who wish to travel to the UK to join their EEA national family members in the UK after March 2019. Applicants apply for EUSS Family Permit to join their EU family member in the UK.  You can come to the UK for only 6 months.

Who are the family members of relevant EU citizens?

The family members of relevant EU nationals who can apply for a Family permit under Appendix EU are:

  • Spouse;
  • Civil partner;
  • Durable partner;
  • Child, grandchild, or great-grandchild of a relevant EEA citizen or their spouse or civil partner
  • Dependent parent, or grandparent or great-grandparent of the relevant EEA citizen or their spouse or civil partner,

 

Eligibility for Appendix EU – Family Permit Entry Clearance

  • You must submit a valid application online.
  • You are a non-British citizen.
  • You need to submit the required proof of your identity and nationality.
  • You have submitted the required biometric data; and
  • The date of application is before 9 August 2023 – if the applicant is a family member of a British Citizen;
  • You must be a non-EEA citizen;
  • You must be a family member of the EEA citizen who you wish to join the EEA national in the UK;
  • The EEA citizen should be residing in the UK or will be traveling to the UK within 6 months of the date of application;
  • You must either accompany your EEA national family member(s) or join a member of a relevant EEA national in the UK (EEA national has got either settled or pre-settled status or has applied for one and waiting for the decision);
  • Your family relation was in place before 31 December 2020;
  • You have been granted an entry visa under this Appendix or have an EEA Family Permit issued under the EEA Regulations.

 

An application made under this Appendix will be refused on grounds of suitability where any of the following apply at the date of decision:

(a) The applicant is subject to a deportation order or to a decision to make a deportation order; or
(b) The applicant is subject to an exclusion order or exclusion decision.

 

Relevant EU citizens

Following are the relevant EU citizens whom you may wish to join in the UK:

  • EEA or Swiss nationals who have been granted Pre-settled or settled status or those who have applied under the EU settlement scheme and waiting for their decision;
  • Irish citizens who fulfill all requirements for a pre-settled status or settled status under the EU settlement scheme. Such Irish citizens don’t need to apply for the EU settlement scheme.
  • Eligible persons of Northern Island who meet the requirements for a pre-settled status or settled status under the EU settlement scheme.
  • British citizens who are also EEA citizens or Swiss citizens and who have lived in the UK as an EEA citizen or Swiss citizen before they received British citizenship.

Applying as a Family member of an EEA National:

Spouse/Civil Partner – Your marriage or civil partnership should have taken place before 31 December 2020 if you wish to join your EEA National partner;

Durable Partner – Your relationship should have begun before 31 December 2020;

Children – Where children make an application and both the parents are in the UK the application is generally straight forward provided the child is under the age of 18 years, however,
where children are above the age of 21 years old, they must prove that they are dependent on their parent for essential living needs;

Parents – The parents applying as a EEA Family Member need to provide evidence that they are
dependent of the EEA National or their Spouse/Civil Partner for essential living needs.

There is no charge you need to pay for Appendix EU – family permit.
