If you have a fiancé who is either a British citizen or has settled status in the UK, you can apply for a UK fiancé visa to join them in the UK. UK fiancé visa is valid for six months only, within which you must marry or get into a civil partnership with your British partner or else you will have to leave the UK. If you get married or enter into a civil partnership with your British partner within six months of granted time as a fiancé, you can apply for a UK spouse visa to continue living with your partner in the UK.
The financial requirement is one of the most important eligibility requirements for UK fiancé visa applicants. One can meet the financial requirements in the following ways:
The minimum annual income of £18,600 from salaried or non-salaried employment of your fiancé and/or you if you are in the UK with permission to work,
Non-employment income, such as dividend income from shares or rental income from property,
Cash savings of your fiancé or yourself or both combined above £16,000 held by your fiancé and/or you for at least six months,
State (UK or foreign), occupational or private pension of your fiancé or you or both,
Income from self-employment and income as a director or employee of a specified limited company in the UK of your fiancé or you or both if you have permission to work in the UK which you can get after getting married to or entering into a civil partnership with your fiancé.
If your fiancé (sponsor) and/or you (with permission to work in the UK) are directors/employees of a specified limited company, you can use income under one of the following categories:
Category F – income from the last full financial year or
Category G – mean average income received in the last two full financial years
Director of a specified Limited Company
A specified limited company in the UK is defined as one in which:
a. The individual is either a director or employee of the company, or both, or of another company within the same group; and
b. Shares are held (directly or indirectly) by the person, their partner, or the following family members of the person or their partner: parent, grandparent, child, stepchild, grandchild, brother, sister, uncle, aunt, nephew, niece or first cousin; and
c. Any remaining shares are held (directly or indirectly) by fewer than five other persons.
The above provision applies to only those specified limited companies registered in the UK. If you or your fiancé or both of you are directors or employees or both of a specified limited company registered in the UK, individual/s or combined income must be calculated under categories F or G.
If you are a director or employee or both of a specified limited company in the UK, you need to provide the following evidential documents:
Company Tax Return CT600 for the last full financial year with evidence of submission;
Evidence of registration with Registrar of Companies (Companies House)
Financial Accounts;
Corporate/business bank statements;
A current Appointment Report from Companies House In addition, you must also provide:
VAT registration certificate and VAT return for the last full financial year confirming registration number if the turnover is more than £79,000 or the threshold applied during the last financial year
Proof of ownership or lease of business premises
Original proof of PAYE registration with HMRC
If you are a director or employee of the company (or both) and you also receive a salary from the company, you will need to provide a copy of your pay slips, a P60, and your bank statements covering the same 12-month period as your CT600.
If you receive dividends, you will need to provide dividend vouchers for all dividends declared in favor of the individual in the period covered by CT600 and personal bank statements showing dividends were paid into the individual’s bank account.
